{"id":16835,"date":"2022-06-07T16:33:00","date_gmt":"2022-06-07T08:33:00","guid":{"rendered":"https:\/\/ijmjk.local\/news\/rescue-of-four-young-brother-kicks-off-child-labour-crackdown-copy\/"},"modified":"2022-06-28T16:47:51","modified_gmt":"2022-06-28T08:47:51","slug":"rock-quarry-owner-guilty-after-exploiting-29-people-in-bondage","status":"publish","type":"news","link":"https:\/\/ijmhk.org\/zh\/news\/rock-quarry-owner-guilty-after-exploiting-29-people-in-bondage\/","title":{"rendered":"\u63a1\u77f3\u5834\u6301\u6709\u4eba\u5728\u5974\u5f79 29 \u4eba\u5f8c\u88ab\u5224\u6709\u7f6a (\u53ea\u6709\u82f1\u6587\u7248)"},"content":{"rendered":"<p class=\"has-medium-font-size\"><strong>CHENNAI, INDIA<\/strong>\u00a0\u2013 On May 31, a specialised court in southern India sentenced a powerful rock quarry owner to seven years in prison for exploiting disadvantaged families in bonded labour.<\/p>\n\n\n\n<p>The Villupuram Special Court for Scheduled Castes and Scheduled Tribes (India\u2019s official roster of disadvantaged ethnic communities) found this man guilty for forcing 29 people to work as slaves and for exploiting their tribal status. This is the first time IJM\u2019s team in Chennai has witnessed a conviction under the SC\/ST Act in a forced labour case\u2014a major breakthrough.<\/p>\n\n\n\n<p>Back in July 2010, IJM had supported local law enforcement in a rescue operation at this rock quarry and brought 34 children, women and men to safety. The government granted 29 Release Certificates (RCs) to break the labourers\u2019 bonds to the owner, including four children who were being forced to work (five others were not working and did not need RCs). The families also got rehabilitation funds to help restart life in freedom.<\/p>\n\n\n\n<p>A case was lodged against the abusive father and son who ran the quarry, but the father later passed away only the son went on to trial.<\/p>\n\n\n\n<p>IJM supported the 12-year legal case for many years, but eventually transitioned it fully to the ownership of public prosecutors. They faced a significant challenge with the defense lawyer\u2014an extremely powerful and experienced local attorney\u2014who frequently bombarded the survivors with questions to intimidate them.<\/p>\n\n\n\n<p>But even against these tactics, the witnesses spoke the truth without fear, and the judge passed a verdict in their favour. IJM commended the prosecutors and judge for their sensitivity to the survivors and their commitment to the truth of the case.<\/p>\n\n\n\n<p>The charges and concurrent sentences handed down by the judge included:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Section 370 of Indian Penal Code (IPC) (buying or disposing of any person as a slave): 7 years imprisonment and a fine of Rs. 5000<\/li><li>Section 374 of IPC (unlawful compulsory labour): 1 year imprisonment<\/li><li>Section 3(1)(vi) of SC ST Act (compelling an SC\/ST member to do \u2018<em>begar\u2019<\/em>&nbsp;or other similar forms of forced or bonded labour): 6 months imprisonment and a fine of Rs. 5000<\/li><li>Section 3(1)(xv) of SC ST Act (forcing an SC\/ST member to leave his place of residence): 6 months imprisonment and a fine of Rs. 5000<\/li><\/ul>\n\n\n\n<p>As this offender begins his sentence, IJM hopes this conviction sends a powerful message to the community\u2014and to the survivors who bravely raised their voices against him.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"601\" height=\"439\" src=\"https:\/\/ijmhk.org\/wp-content\/uploads\/2022\/06\/IJM-June-News_South-Asia_In-story-photo.jpg\" alt=\"\" class=\"wp-image-16838\" srcset=\"https:\/\/ijmhk.org\/wp-content\/uploads\/2022\/06\/IJM-June-News_South-Asia_In-story-photo.jpg 601w, https:\/\/ijmhk.org\/wp-content\/uploads\/2022\/06\/IJM-June-News_South-Asia_In-story-photo-300x219.jpg 300w, https:\/\/ijmhk.org\/wp-content\/uploads\/2022\/06\/IJM-June-News_South-Asia_In-story-photo-16x12.jpg 16w\" sizes=\"auto, (max-width: 601px) 100vw, 601px\" \/><\/figure><\/div>\n\n\n\n<p>One survivor named Selvam, pictured above, who had been trapped in the rock quarry for four years, remembers,\u00a0<strong>\u201cBefore I was rescued, I feared everyone\u2014not only the owner but also the government officials\u2026I was full of fear when I entered the court for cross-examination for the first time.\u201d<\/strong><\/p>\n\n\n\n<p>But today, Selvam and the other survivors are feeling more confident and seeing improvements in their justice system. He adds,<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>\u201cToday, I feel that officials are more sensitive toward our needs, especially when they know that we are survivors of bonded labour.\u201d<\/p><\/blockquote>\n\n\n\n<p>He and his wife, Kannamma, lead a peaceful life and are overjoyed that their days as victims of bonded labour are behind them.<\/p>\n\n\n\n<p>Together, they work as daily-wage labourers and also make the best use of the government\u2019s guaranteed-work program for impoverished communities.
